Liputan Kes Najib-Altantuya (4 Julai 2008 - Bhg 2)

SMEARS THICKEN THE PLOT IN MALAYSIAN POLITICS

Friday, 04 July 2008

The Guardian

A national drama involving leading government figures, conspiracy claims, personal smears, sodomy allegations and a grisly murder appears to be driving Malaysia inexorably towards its biggest political upheaval since independence in 1957.

Act One of this unfolding epic was played out in March's general election when the ruling Barisan Nasional coalition suffered heavy losses at the hands of Datuk Seri Anwar Ibrahim's PKR party and its allies. Although it held on to power, the government's parliamentary majority was slashed to 58 seats.

The results seriously wounded the prime minister, Datuk Seri Abdullah Ahmad Badawi, already criticised as a weak, uninspiring leader, and triggered a power struggle within his Umno.

With the party facing defeat for the first time since the British left, and with tens of millions of dollars in public contracts and patronage at stake, the plot has thickened in recent days.

First Datuk Seri Najib Razak, the ambitious deputy prime minister and Abdullah's presumed heir, was linked in sworn court testimony to the 2006 murder of a Mongolian female translator with whom, it was claimed, he once had a sexual relationship. The killing of Altantuya Shaariibuu was particularly gruesome, her body having been blown to bits with explosives in a jungle clearing.

Then last week a university dropout told police he had been sodomised by Anwar in a luxury apartment. The allegation was similar to claims made against the married father-of-six in 1998 after Anwar, as deputy prime minister, fell out with Tun Dr Mahathir Mohamad, the prime minister at the time. Anwar was beaten by police, tried, found guilty and jailed ─ only for the verdict to be overturned by the federal court after Mahathir retired.

Anwar has dismissed the allegation as a transparent, repeat attempt to smear him, part of a conspiracy that he said was hatched by Najib and high police officials to block his path to power.

"He [Najib] feared that I will use the Altantuya case against him to embarrass him and probably lead to his downfall," he said this week.

Najib firmly denies involvement in any conspiracy and also denies any connection with the murdered Mongolian.

Malaysia's raucous media has, meanwhile, been having a field day. Writing in The Star, commentator Suhaimi Aznam even suggested Anwar had invented the sodomy allegation to embarrass the government ─ and labelled him a drama queen.

Dr Mahathir also weighed in, saying he was "not surprised at all" by the new claim. And the complainant's fiancee, who says shoes are her real passion in life, has told the papers that she will stand by her man and bravely weather the storm.

Tian Chua, the PKR party information chief and a new MP, said the sodomy claim had backfired. "This allegation is not sticking. The latest poll shows 60% of people think it's nonsense, only 10% believe it's true," he said. "The government did it to get some breathing space, to deflect attention from the crumbling of their party."

Tian said Anwar had started legal proceedings against his accuser and against senior police officers involved in the previous case 10 years ago. The opposition leader would also begin a "national fightback tour" this weekend. "We are going on the offensive for the next 100 days," he said. The final act of the drama would come in September when he predicted the opposition would have enough parliamentary seats to defeat the government.

Not everyone agrees that denouement is certain or even likely. Anwar's political comeback has become one of the longest running shows in Southeast Asia. Abdullah has vowed to stay on. And Dr Mahathir reportedly suffered a mild heart attack yesterday. Amid the furore, cooler heads urge caution.

"I think we have to wait and reserve judgment until the police investigation [into the sodomy claim] is complete," said a leading political analyst in Kuala Lumpur. "All of this is beginning to resemble a circus. We are becoming a laughing stock."

POLITICIANS STICK TO BATTLE LINES OVER NAJIB'S ALLEGED ROLE

Friday, 04 July 2008

By Hazlin Hassan, The Straits Times

MALAYSIA'S politicians have stuck to their battle lines regarding the allegations by a private investigator linking Deputy Prime Minister Najib Razak to a murdered Mongolian woman.

Private eye Balasubramaniam Perumal claimed that the police had omitted certain facts when investigating the murder, including an alleged link between Ms Altantuya Shaariibuu and Datuk Seri Najib.

Opposition politicians say the police must investigate the claims, while Umno leaders rubbish them.

Meanwhile, commentators and postings on major political websites and blogs are calling on Datuk Seri Najib to disprove the allegations.

The allegations against Mr Najib were unveiled by opposition leader Anwar Ibrahim yesterday at the headquarters of Parti Keadilan Rakyat (PKR). He trotted out a statutory declaration by the private investigator.

This led opposition Parti Islam SeMalaysian deputy president Nasharuddin Mat Isa to call for an independent commission to investigate the claims, to ensure the probe is unbiased.

Too many statutory declarations were being filed, he said, adding: 'One after the other, we start filing so many statutory declarations. It will start to have no value.'

Indeed, while the sworn statements have been explosive, they came as a disappointment to some who were hoping to see concrete proof of a conspiracy in the Altantuya case.

Prominent blogger Ahirudin Attan said: 'I was hoping for solid evidence that would bring a closure to the Altantuya murder case. Instead, I get another statutory declaration based on hearsay, a lot of hearsay.'

Blogger bigdogdotcom asked why the sworn statement was revealed 'on a PKR platform and at this point of time when de facto leader Anwar Ibrahim is being accused of yet what seems to be another sodomy charge'.

Analysts said the accusations against Mr Najib could pose yet another headache for Prime Minister Abdullah Badawi's ruling party Umno, which is already reeling from its dismal performance at the March elections.

Ms Tricia Yeoh, director of the independent Centre for Public Policy Studies, said: 'Assuming the truth of the statutory declaration, it should be of great concern to every Malaysian that investigation procedures are handled poorly, with omission of important information, and that the police force has not seemed to act independently of political influence.'

But government leaders such as Umno Youth secretary-general Abdul Rahman Dahlan lambasted the allegations as 'ridiculous and preposterous'.

He said: 'A statutory declaration is challengeable in court anyway. It is not something that is factual.

'I believe Malaysians at the end of the day will have common sense. Everybody must remain calm.'

It’s a pack of lies to smear my reputation, says Najib

KUALA LUMPUR: Deputy Prime Minister Datuk Seri Najib Tun Razak has reiterated that he had neither met nor known Altantuya Shaariibuu.

“The statutory declaration, which I consider a horrible lie, a mere fabrication with malicious intention and slanderous element is aimed at smearing my image,” he told a packed press conference held at about 7pm at his office in Parliament Building here yesterday.

Najib said the statutory declaration by private investigator P. Balasubramaniam was a “red herring” by Datuk Seri Anwar Ibrahim to divert public attention from the sodomy allegation against the PKR adviser.

“I am very sure that this is a very desperate attempt to divert attention from the sodomy allegation that Anwar is facing now. “What is important now is not the matter raised as a diversion, (or as a) red herring. ... What people want to know is whether the sodomy case happened or not. I hope the relevant authorities will investigate and make an announcement as soon as possible,” he said.

On the statutory declaration, Najib said as it contradicted the testimonies in court and also the police report, he would leave it to the authorities to investigate fully, but stressed that he also had rights as a citizen to defend himself.

“I can take personal action, but what is more important is that action can be taken because there are provisions of the law like defamation and so forth,” he added.
Najib also denied that he had had a sexual relationship with Altantuya, nor did he conspire to cover up her murder as alleged by Balasubramaniam.

"No, absolutely not, because I have never ever met her," he said

Asked whether he was willing to be investigated, he said: “Why should I be investigated? Give me a good reason. The police have investigated the entire Altantuya case, so they know everything.

“The parties responsible (for the statutory declaration) should be prepared to accept any consequences if the authorities uncover any legal wrongdoing.”

Najib questioned why the matter had to come up now after Anwar was recently accused of sodomy.

“Now, suddenly everyone is under attack, the Inspector-General of Police, the Attorney-General, even I am attacked. “Why now? This is the question,” he added. “If he (Anwar) was so concerned about the case he should have brought it up much, much earlier. Why now?” he added.

Asked whether the latest accusations would affect him during the coming Umno elections, Najib said it would not.

“I’m very relaxed about it. As you can see I’m still smiling. I’m not worried at all because the truth will prevail,” he added.

Najib said he believed in the (justice) system and stressed that he had not done anything wrong.

“There’s nothing to be worried about. Life goes on as usual. As far as I’m concerned, it’s business as usual,” he added

Mahfuz raises latest allegation against Najib in Parliament

KUALA LUMPUR: PAS information chief Mahfuz Omar has gone where angels fear to tread and brought up the latest allegation by a private investigator against Deputy Prime Minister Datuk Seri Najib Tun Razak in his debate at the Dewan Rakyat at 4.30pm.The Pokok Sena MP, who had earlier been criticising the Government’s policies on the control of fuel prices, took many MPs by surprise when he raised the issue at the tail end of his debate.

This prompted Deputy Speaker Datuk Dr Wan Junaidi Tuanku Jaafar to remind Mahfuz that “his time was up” while some of the backbenchers took to heckling him. Touching on the ministerial statement delivered by Najib on Monday to further explain the social restructuring policies under the Mid-Term Review report, Mahfuz said this was equivalent to a “no-confidence’ motion against Prime Minister Datuk Seri Abdullah Ahmad Badawi.

“His (Najib’s) wife has been implicated in the statutory declaration by Raja Petra Kamarudin, which claimed that she was present during (Mongolian translator) Altantuya (Shaariibuu)’s murder.

“And the latest allegation by private investigator P. Balasubramaniam in his own statutory declaration that Altantuya had been promised US$500,000 commission from the sale of a submarine – what about all these statutory declarations? How is the investigation into all these claims going to be?” Mahfuz asked.

At this point, someone was heard shouting that “just because it’s a statutory declaration, this doesn’t mean it’s the truth”.

There were also jeers for Mahfuz not to fitnah (slander) and a slow rumble of disapproval could be heard from among the backbenchers.

He only sat down after Wan Junaidi repeatedly told him his debate time was over.

Lawyer to consult with Abdul Razak first

PETALING JAYA: Lawyer Wong Kian Kheong said he will consult his client Abdul Razak Baginda on the statutory declaration made by the political analyst’s former private eye. He said this was after the statutory declaration was brought to his attention.

“I need to seek instructions from my client,” he told The Star yesterday when asked about the statutory declaration made by P. Balasubramaniam, who had testified as the first prosecution witness in the Altantuya Shaariibuu murder trial.

The declaration was also news to Datuk Hazman Ahmad and Kamarul Hisham Kamaruddin, the lawyers representing the two policemen charged with the murder. Hazman, counsel for C/Insp Azilah Hadri, said he was “very surprised” with the contents of the statutory declaration by the private investigator, who had been hired by Abdul Razak to keep the Mongolian woman away from him.

“I really don’t know where these details came from. This is the first time I’m hearing this,” the lawyer said yesterday.

Hazman said it was a practice for him to always ask his clients everything that had transpired when he accepted their cases.

“I only know of what my client had told me, and all of that was presented in court,” he said.

Kamarul Hisham, counsel for Kpl Sirul Azhar Umar, said these allegations needed to be investigated.

“I have only read the declaration based on what was posted online,” he added.
Kamarul Hisham said the declaration was extraneous material as far as the trial was concerned.

“However, if there is any truth to the declaration, then it throws a big question on the culpability of the three people standing trial for the murder,” he said.

Kit Siang: DPM should go on leave

KUALA LUMPUR: Deputy Prime Minister Datuk Seri Najib Tun Razak should go on leave until allegations about his involvement in the murder of Mongolian Altantuya Shaariibuu are cleared, said DAP adviser Lim Kit Siang.

In a statement issued, Lim said private investigator P. Balasubramaniam’s statutory declaration yesterday had “challenged the truth and veracity of various statements and denials by Najib”.

“Najib, as well as Prime Minister Datuk Seri Abdullah Ahmad Badawi, cannot allow Balasubramaniam’s statutory declaration to go unchallenged as it raises grave fundamental issues as to their fitness to hold high political offices.”

He added that the issues brought up by Balasubramaniam were of urgent public importance, which Parliament should take immediate cognisance by having an immediate debate.

Suspend Musa and Gani, says PKR Youth

PUTRAJAYA: PKR Youth wants Inspector-General of Police Tan Sri Musa Hassan and Attorney-General Tan Sri Abdul Gani Patail to be suspended pending investigations into their alleged abuse of power.

PKR Youth chief Shamsul Iskandar Mohd Akin said there could be interference in the investigations should Musa and Gani remain in office.

The Anti-Corruption Agency (ACA) has started a probe into a police report lodged by PKR de facto leader Datuk Seri Anwar Ibrahim alleging abuse of power by the two in the infamous “black eye” case in 1998.

Shamsul and several youth leaders handed over a four-page memorandum to the Prime Minister yesterday. The Prime Minister’s principal private secretary Datuk Ahmad Yaacob received the memorandum.

Shamsul said that in the absence of Musa, Deputy IGP Tan Sri Ismail Omar could take charge while a Deputy Public Prosecutor could assume Gani’s duties.

Liputan Kes Najib-Altantuya (3 Julai 2008 - Bhg 2)

Kenyataan Media & Pengakuan Bersumpah mengenai hubungan Najib & Altantuya

ANWAR IBRAHIM

The Star : Friday July 4, 2008

Anwar: Proof on Najib soon

KUALA LUMPUR: Evidence allegedly linking Datuk Seri Najib Tun Razak to murdered Mongolian translator Altantuya Shaariibuu will be released in the next few days.

“The next evidence will come in the next few days. Just be patient. This is not the end. I just want to test the nerve and commitment of the Prime Minister,” said PKR de facto leader Datuk Seri Anwar Ibrahim.

He was taking questions from reporters at the press conference where private investigator P. Balasubramaniam – once hired by Abdul Razak Baginda – released a statutory declaration that alleged Najib’s involvement with Altantuya.

Anwar pointed out that when his wife Datin Seri Dr Wan Azizah Wan Ismail and daughter Nurul Izzah met the Prime Minister in Parliament on Tuesday, Datuk Seri Abdullah Ahmad Badawi gave the assurance that he would investigate Anwar’s recent police report against the Attorney-General (A-G) and Inspector-General of Police (IGP) about fabricating evidence in the 1998 infamous “black eye” incident.

Anwar, however, noted that just 10 minutes after Abdullah gave the assurance, he (Abdullah) told reporters he had full confidence in the A-G and IGP.

“So I don’t know what he means by giving that assurance because my police report involves these two key institutions and they had fabricated evidence against me,” he said.

Likening the latest allegation on the Altantuya case to the V.K. Lingam video-clip saga, Anwar said it was like a series in a Bollywood drama.

Anwar said he was not interested in the personal nature of a purported relationship between Najib and Altantuya because that was “his and her business.”

But what concerned him was Balasubramaniam’s allegations that the police had suppressed evidence, adding that “such suppression could have only happened with the full knowledge of top public officials such as the IGP and the A-G.”

“Suppression of information is a crime,” he charged.

He questioned whether the suppression of the evidence was also the reason behind the last minute switch in the deputy public prosecutor handling the case and the reason why the DPP – Salehuddin Saidin – had put in papers for early retirement.

He also questioned why the head of criminal division of the A-G’s chambers, Datuk Yusof Zainal Abiden, was completely sidelined from the case.

He added there were also questions now why there was a sudden switching of the judge fixed to hear the case.

“Did Datuk Seri Najib lie when he said he had never met Altantuya before? Did Datuk Seri Najib lie when he said that he was not involved in any commission deals for the purchase of the Scorpene submarines,” he said.

Anwar alleged the revelations showed a “clear and consistent pattern of abuse of power and manipulation of the criminal justice system” which was evident during his case back in 1998 and this time too it involved the same people – Najib, A-G Tan Sri Gani Patail and IGP Tan Sri Musa Hassan.

“These are serious implications for the administration of justice in the country where institutions like the police, A-G’s office and judiciary are already tarnished,” he said, calling for the setting up of a Royal Commission of Inquiry.

To a question, Anwar said he had reason to believe that Najib’s people had been aware that he (Anwar) had been in the process of obtaining a statutory declaration on the Altantuya case and this was what triggered the recent sodomy allegations against him by 23-year-old Mohd Saiful Bukhari Azlan.

He said these people were making a “big blunder” by accusing him of sodomy and that he had a strong alibi.

He also said his lawyer had advised him against saying more on the case and that he would reveal all in court.

PKR vice-president R. Sivarasah, who is a lawyer, said it was obvious now from Balasubramaniam’s statutory declaration that it would lead to a mistrial of the Altantuya case.

He said it was timely that Balasubramaniam had come forward with his sworn statement because it allows the prosecution to do something about it.

Anwar: Tubuh s'jaya siasatan diraja

Jimadie Shah Othman Malaysiakini : Jul 3, 08

Balasubramaniam hadir bersama peguamnya Americk Sidhu.

Pak Lah stays mum on allegations against Najib

KUALA LUMPUR: Prime Minister Datuk Seri Abdullah Ahmad Badawi has declined comment on the latest allegations, which were contained in a statutory declaration, against his deputy, saying that the matter now rests with the court.

He said Datuk Seri Najib Tun Razak had however told him of the allegations but did not discuss the matter.

“I know that he wants to seek the views of the Attorney-General because the matter is with the court now.

“I don’t think this matter should be raised now and I don’t want to comment on it.
“In my opinion, it’s subjudice,” Abdullah told reporters here yesterday.

When told that PKR adviser Datuk Seri Anwar Ibrahim had divulged contents of the declaration by P. Balasubramaniam, the private investigator hired by Abdul Razak Baginda, Abdullah said: “Lagi riuhlah (It will be more lively now). What is he doing to confuse us again?

“Tak habis dengan cerita ini? (Is there no end to this story?).”

Liputan Kes Najib-Altantuya (3 Julai 2008- Bhg 1)

Najib dituduh bersama Altantuya

Jimadie Shah Othman Malaysiakini : Jul 3, 08

- Wanita itu pernah dijanjikan wang komisyen US$500,000 berhubung urusan pembelian kapal selam.

PI: Cops left out vital info

KUALA LUMPUR: Police omitted pertinent information allegedly linking Deputy Prime Minister Datuk Seri Najib Tun Razak with the Altantuya Shaariibuu murder case, claimed private investigator P. Balasubramaniam in a statutory declaration.
Balasubramaniam declared he had informed police what Abdul Razak Baginda had purportedly told him prior to Altantuya's murder.

He revealed yesterday the content of the statutory declaration at a press conference organised by PKR de facto leader Datuk Seri Anwar Ibrahim together with PKR office bearers, MPs and lawyers at the party's headquarters in Tropicana, just outside Kuala Lumpur.

He said Razak had told him that he was introduced to Altantuya by Datuk Seri Najib Tun Razak at a diamond exhibition in Singapore and that Najib had told him that he (Najib) and Altantuya had had a sexual relationship and that “she was susceptible to anal intercourse”.

Balasubramaniam said Razak had also told him that Najib had asked him (Razak) “to look after” Altantuya, who was also known as “Aminah”, because he did not want her to harass him now that he was the Deputy Prime Minister.

He claimed Razak had told him that Altantuya had wanted money as she felt entitled to a US$500,000 (RM1.65mil) commission from a submarine deal that she had assisted the Malaysian Government secure in Paris; and that Najib, Razak and Altantuya all had dinner together in Paris.

Balasubramaniam said the day Razak was arrested for abetting in the murder of Altantuya, he (Balasubramaniam) was with Razak at a lawyer’s office where Razak showed him Najib’s SMS which he received while they were both in the office.
Najib’s message to Razak supposedly said: “I am seeing the IGP at 11am today ... matter will be solved ... be cool.”

“I was sitting just beside Razak and he told me he had sent an SMS to Najib and never received a reply. Then he received the reply. He showed me the reply and also to the lawyer,” Balasubramaniam said

PKR said it was Balasubramaniam who approached them about the Altantuya case and not the other way around.

Altantuya was murdered between Oct 19 and Oct 20, 2006 and her body blown up using C4 explosives.

Razak is on trial for abetting with the murder while two police officers Kpl Sirul Azhar Umar and C/Insp Azilah Hadri are charged with her murder.

Balasubramaniam said Razak had given him all this information about Najib “in an attempt to persuade me to continue my employment with him”.

He alleged that the police however omitted all this information in his police statement made in November 2006 but he signed it anyway because after being in the lock-up for seven days he just wanted to go home.

“If you have experienced being in a lock-up, definitely you will sign the statement. I have three children (to think about).

”I was arrested under (Section) 302 (for murder). What’s the reason? In the first place there was no reason for the police to put me in the lock-up. They can call me anytime to take a statement. I was the private investigator for Razak,” he said.

Balasubramaniam was a former police officer who joined the force in 1981. He resigned in 1998 when he was with the Special Branch and has been working as a freelance private investigator since then.

He was first employed by Razak in June 2006 for 10 days and again in October the same year.

Balasubramaniam’s lawyer Americk Sidhu said his client decided to come up with his statutory declaration after the prosecution closed the Altantuya case on June 23.
“He was waiting for the prosecution to bring up the evidence and was very surprised that this matter was not raised,” he said.

Sidhu said Balasubramaniam did not say anything about the information Razak shared with him on Najib and Altantuya in court when he testified in the Altantuya trial because the prosecution did not question him about it.

He also stressed that Balasubramaniam’s statutory declaration was “not a statement of truth” but rather what had been said to him by Razak and Altantuya.

“Whether true or not – he doesn’t know for sure. He just told what was told to him,” he said, adding that the purpose of the press conference was to bring to light that “there is this evidence available”.

“And if the prosecution wants to use it, Bala is available at anytime,” he said.
In his statutory declaration, Balasubramaniam also said that Razak had told him that Altantuya was a great liar and good at convincing people.

He said when he met Altantuya, she, too, told him that she met Razak and Najib in Singapore, and that they had dinner in Paris and that she was promised US$500,000 as commission for assisting in the submarine deal. She also told him that Razak had bought her a house in Mongolia but her brother had refinanced it and she needed money to redeem her home.

Balasubramaniam claimed that Altantuya had also told him that Razak had married her in South Korea and asked if Balasubramaniam could arrange for her to see Najib while she was in Malaysia.

Balasubramaniam said that on Oct 20 after Altantuya had gone missing, two of her friends showed up at Razak’s home asking where she was. He added that they came back a few days later convinced that she was being held in his house.

Following a commotion outside Razak’s house, he said, he called the police, as well as Razak to inform him of what was happening outside his front gate. He said Razak told him a DSP Musa Safri would call him back on his handphone and to pass that call to the inspector from Dang Wangi police station.

He said he did that and following the call, which lasted three to four minutes, the inspector told the two girls to leave and come see him the next day.

Balasubramaniam said he wanted to bring to notice the strong possibility that there were individuals other than the three accused involved in the murder and that he was disappointed at the standard of investigation conducted by the authorities.

He also wanted to persuade the relevant authorities to reopen their investigation so that fresh evidence may be presented.

To a question, Balasubramaniam said now that he had come out with the statutory declaration, he was worried for his personal safety.

Akuan Bersumpah dakwa Najib-Altantuya ada hubungan

Azamin Amin

Liputan Kes Najib-Altantuya (2 Julai 2008)

Pengakuan Rosmah tidak cukup, kes bunuh bukan isu kecil - Mahfuz

Azamin Amin Wed Jul 02, 08 3:06:01 pm MYT

STATUTORY DECLARATION OF P BALA

STATUTORY DECLARATION

I, Balasubramaniam a/l Perumal (NRIC NO: xxxxxx-xx-6235) a Malaysian Citizen of full age and residing at xxxxx, Selangor do solemly and sincerely declare as follows :-

1. I have been a police officer with the Royal Malaysian Police Force having jointed as a constable in 1981 attached to the Police Field Force. I was then promoted to the rank of lance Corporal and finally resigned from the Police Force in 1998 when I was with the Special Branch.

2. I have been working as a free lance Private Investigator since I left the Police Force.

3. Sometime in June or July 2006, I was employed by Abdul Razak Baginda for a period of 10 days to look after him at his office at the Bangunan Getah Asli, Jalan Ampang between the hours of 8.00 a.m. to 5.00 p.m each working day as apparently he was experiencing disturbances from a third party.

4. I resigned from this job after 2 ½ days as I was not receiving any proper instructions.

5. I was however re-employed by Abdul Razak Baginda on the 05-10-2006 as he had apparently received a harassing phone call from a Chinese man calling himself ASP Tan who had threatened him to pay his debts. I later found out this gentleman was in fact a private investigator called Ang who was employed by a Mongolian woman called Altantuya Shaaribuu.

6. Abdul Razak Baginda was concerned that a person by the name of Altantuya Shaaribuu, a Mongolian woman, was behind this threat and that she would be arriving in Malaysia very soon to try and contact him.

7. Abdul Razak Baginda informed me that he was concerned by this as he had been advised that Altantuya Shaaribuu had been given some powers by a Mongolian ‘bomoh’ and that he could never look her in the face because of this.

8. When I enquired as to who this Mongolian woman was, Abdul Razak Baginda informed me that she was a friend of his who had been introduced to him by a VIP and who asked him to look after her financially.

9. I advised him to lodge a police report concerning the threatening phone call he had received from the Chinese man known as ASP Tan but he refused to do so as he informed me there were some high profile people involved.

10. Abdul Razak Baginda further told me that Altantuya Shaaribuu was a great liar and good in convincing people. She was supposed to have been very demanding financially and that he had even financed a property for her in Mongolia.

11. Abdul Razak Baginda then let me listen to some voice messages on his handphone asking him to pay what was due otherwise he would be harmed and his daughter harassed.

12. I was therefore supposed to protect his daughter Rowena as well.

13. On the 09.10.2006 I received a phone call from Abdul Razak Baginda at about 9.30 a.m. informing me that Altantuya was in his office and he wanted me there immediately. As I was in the midst of a surveillance, I sent my assistant Suras to Abdul Razak Baginda’s office and I followed a little later. Suras managed to control the situation and had persuaded Altantuya and her two friends to leave the premises. However Altantuya left a note written on some Hotel Malaya note paper, in English, asking Abdul Razak Baginda to call her on her handphone (number given) and wrote down her room number as well.

14. Altantuya had introduced herself to Suras as ‘Aminah’ and had informed Suras she was there to see her boyfriend Abdul Razak Baginda.

15. These 3 Mongolian girls however returned to Abdul Razak Baginda’s office at the Bangunan Getah Asli, Jalan Ampang again, the next day at about 12.00 noon. They did not enter the building but again informed Suras that they wanted to meet Aminah’s boyfriend, Abdul Razak Baginda.

16. On the 11.10.2006, Aminah returned to Abdul Razak Baginda’s office on her own and gave me a note to pass to him, which I did. Abdul Razak Baginda showed me the note which basically asked him to call her urgently.

17. I suggested to Abdul Razak Baginda that perhaps it may be wise to arrange for Aminah to be arrested if she harassed him further, but he declined as he felt she would have to return to Mongolia as soon as her cash ran out.

18. In the meantime I had arranged for Suras to perform surveillance on Hotel Malaya to monitor the movements of these 3 Mongolian girls, but they recognized him. Apparently they become friends with Suras after that and he ended up spending a few nights in their hotel room.

19. When Abdul Razak Baginda discovered Suras was becoming close to Aminah he asked me to pull him out from Hotel Malaya.

20. On the 14.10.2006, Aminah turned up at Abdul Razak Baginda’s house in Damansara Heights when I was not there. Abdul Razak Baginda called me on my handphone to inform me of this so I rushed back to his house. As I arrived, I noticed Aminah outside the front gates shouting “Razak, bastard, come out from the house”. I tried to calm her down but couldn’t so I called the police who arrived in 2 patrol cars. I explained the situation to the police, who took her away to the Brickfields police station.

21. I followed the patrol cars to Brickfields police station in a taxi. I called Abdul Razak Baginda and his lawyer Dirren to lodge a police report but they refused.

22. When I was at the Brickfields police station, Aminah’s own Private Investigator, one Mr. Ang arrived and we had a discussion. I was told to deliver a demand to Abdul Razak Baginda for USD$500,000.00 and 3 tickets to Mongolia, apparently as commission owed to Aminah from a deal in Paris.

23. As Aminah had calmed down at this stage, a policewoman at the Brickfields police station advised me to leave and settle the matter amicably.

24. I duly informed Abdul Razak Baginda of the demands Aminah had made and told him I was disappointed that no one wanted to back me up in lodging a police report. We had a long discussion about the situation when I expressed a desire to pull out of this assignment.

25. During this discussion and in an attempt to persuade me to continue my employment with him, Abdul Razak Baginda informed me that :-

25.1 He had been introduced to Aminah by Datuk Seri Najib Tun Razak at a diamond exhibition in Singapore.

25.2 Datuk Seri Najib Tun Razak informed Abdul Razak Baginda that he had a sexual relationship with Aminah and that she was susceptible to anal intercourse.

25.3 Datuk Seri Najib Tun Razak wanted Abdul Razak Baginda to look after Aminah as he did not want her to harass him since he was now the Deputy Prime Minister.

25.4 Datuk Seri Najib Tun Razak, Abdul Razak Baginda and Aminah had all been together at a dinner in Paris.

25.5 Aminah wanted money from him as she felt she was entitled to a USD$500,000.00 commission on a submarine deal she assisted with in Paris.

26. On the 19.10.2006, I arrived at Abdul Razak Baginda’s house in Damansara Heights to begin my night duty. I had parked my car outside as usual. I saw a yellow proton perdana taxi pass by with 3 ladies inside, one of whom was Aminah. The taxi did a U-turn and stopped in front of the house where these ladies rolled down the window and wished me ‘Happy Deepavali’. The taxi then left.

27. About 20 minutes later the taxi returned with only Aminah in it. She got out of the taxi and walked towards me and started talking to me. I sent an SMS to Abdul Razak Baginda informing him “Aminah was here”. I received an SMS from Razak instructing me “To delay her until my man comes”.

28. Whist I was talking to Aminah, she informed me of the following :-

28.1 That she met Abdul Razak Baginda in Singapore with Datuk Seri Najib Tun Razak.

28.2 That she had also met Abdul Razak Baginda and Datuk Seri Najib Tun Razak at a dinner in Paris.

28.3 That she was promised a sum of USD$500,000.00 as commission for assisting in a Submarine deal in Paris.

28.4 That Abdul Razak Baginda had bought her a house in Mongolia but her brother had refinanced it and she needed money to redeem it.

28.5 That her mother was ill and she needed money to pay for her treatment.

28.6 That Abdul Razak Baginda had married her in Korea as her mother is Korean
whilst her father was a Mongolian/Chinese mix.

28.7 That if I wouldn’t allow her to see Abdul Razak Baginda, would I be able to arrange for her to see Datuk Seri Najib Tun Razak.

29. After talking to Aminah for about 15 minutes, a red proton aeroback arrived with a woman and two men. I now know the woman to be Lance Corporal Rohaniza and the men, Azilah Hadri and Sirul Azahar. They were all in plain clothes. Azilah walked towards me while the other two stayed in the car.

30. Azilah asked me whether the woman was Aminah and I said ‘Yes’. He then walked off and made a few calls on his handphone. After 10 minutes another vehicle, a blue proton saga, driven by a Malay man, passed by slowly. The drivers window had been wound down and the driver was looking at us.

31. Azilah then informed me they would be taking Aminah away. I informed Aminah they were arresting her. The other two persons then got out of the red proton and exchanged seats so that Lance Corporal Rohaniza and Aminah were in the back while the two men were in the front. They drove off and that is the last I ever saw of Aminah.

32. Abdul Razak Baginda was not at home when all this occurred.

33. After the 19.10.2006, I continued to work for Abdul Razak Baginda at his house in Damansara Heights from 7.00 p.m. to 8.00 a.m. the next morning, as he had been receiving threatening text messages from a woman called ‘Amy’ who was apparently ‘Aminah’s’ cousin in Mongolia.

34. On the night of the 20.10.2006, both of Aminah’s girl friends turned up at Abdul Razak Baginda’s house enquiring where Aminah was. I informed them she had been arrested the night before.

35. A couple of nights later, these two Mongolian girls, Mr. Ang and another Mongolian girl called ‘Amy’ turned up at Abdul Razak Baginda’s house looking for Aminah as they appeared to be convinced she was being held in the house.

36. A commotion began so I called the police who arrived shortly thereafter in a patrol car. Another patrol car arrived a short while later in which was the investigating officer from the Dang Wangi Police Station who was in charge of the missing persons report lodged by one of the Mongolians girls, I believe was Amy.

37. I called Abdul Razak Baginda who was at home to inform him of the events taking place at his front gate. He then called DSP Musa Safri and called me back informing me that Musa Safri would be calling handphone and I was to pass the phone to the Inspector from Dang Wangi Police Station.

38. I then received a call on my handphone from Musa Safri and duly handed the phone to the Dang Wangi Inspector. The conversation lasted 3 - 4 minutes after which he told the girls to disperse and to go to see him the next day.

39. On or about the 24.10.2006, Abdul Razak Baginda instructed me to accompany him to the Brickfields police station as he had been advised to lodge a police report about the harassment he was receiving from these Mongolian girls.

40. Before this, Amy had sent me an SMS informing me she was going to Thailand to lodge a report with the Mongolian consulate there regarding Aminah’s disappearance. Apparently she had sent the same SMS to Abdul Razak Baginda. This is why he told me he had been advised to lodge a police report.

41. Abdul Razak Baginda informed me that DPS Musa Safri had introduced him to one DSP Idris, the head of the Criminal division, Brickfields police station, and that Idris had referred him to ASP Tonny.

42. When Abdul Razak Baginda had lodged his police report at Brickfields police station, in front of ASP Tonny, he was asked to make a statement but he refused as he said he was leaving for overseas. He did however promise to prepare a statement and hand ASP Tonny a thumb drive. I know that this was not done as ASP Tonny told me.

43. However ASP Tonny asked me the next day to provide my statement instead and so I did.

44. I stopped working for Abdul Razak Baginda on the 26.10.2006 as this was the day he left for Hong Kong on his own.

45. In mid November 2006, I received a phone call from ASP Tonny from the IPK Jalan Hang Tuah asking me to see him regarding Aminah’s case. When I arrived there I was immediately arrested under S.506 of the Penal Code for Criminal intimidation.

46. I was then placed in the lock up and remanded for 5 days. On the third day I was released on police bail.

47. At the end of November 2006, the D9 department of the IPK sent a detective to my house to escort me to the IPK Jalan Hang Tuah. When I arrived, I was told I was being arrested under S.302 of the Penal Code for murder. I was put in the lock up and remanded for 7 days.

48. I was transported to Bukit Aman where I was interrogated and questioned about an SMS I had received from Abdul Razak Baginda on the 19.10.2006 which read “delay her until my man arrives”. They had apparently retrieved this message from Abdul Razak Baginda’s handphone.

49. They then proceeded to record my statement from 8.30 a.m. to 6.00 p.m. everyday for 7 consecutive days. I told them all I knew including everything Abdul Razak Baginda and Aminah had told me about their relationships with Datuk Seri Najib Tun Razak but when I came to sign my statement, these details had been left out.

50. I have given evidence in the trial of Azilah, Sirul and Abdul Razak Baginda at the Shah Alam High Court. The prosecutor did not ask me any questions in respect of Aminah’s relationship with Datuk Seri Najib Tun Razak or of the phone call I received from DSP Musa Safri, whom I believe was the ADC for Datuk Seri Najib Razak and/or his wife.

51. On the day Abdul Razak Baginda was arrested, I was with him at his lawyers office at 6.30 a.m. Abdul Razak Baginda informed us that he had sent Datuk Seri Najib Tun Razak an SMS the evening before as he refused to believe he was to be arrested, but had not received a response.

52. Shortly thereafter, at about 7.30 a.m., Abdul Razak Baginda received an SMS from Datuk Seri Najib Tun Razak and showed, this message to both myself and his lawyer. This message read as follows :- ” I am seeing IGP at 11.00 a.m. today …… matter will be solved … be cool”.

53. I have been made to understand that Abdul Razak Baginda was arrested the same morning at his office in the Bangunan Getah Asli, Jalan Ampang.

54. The purpose of this Statutory declaration is to :-

54.1 State my disappointment at the standard of investigations conducted by the authorities into the circumstances surrounding the murder of Altantuya Shaaribuu.

54.2 Bring to the notice of the relevant authorities the strong possibility that there are individuals other than the 3 accused who must have played a role in the murder of Altantuya Shaaribuu.

54.3 Persuade the relevant authorities to reopen their investigations into this case immediately so that any fresh evidence may be presented to the Court prior to submissions at the end of the prosecutions case.

54.4 Emphasize the fact that having been a member of the Royal Malaysian Police Force for 17 years I am absolutely certain no police officer would shoot someone in the head and blow up their body without receiving specific instructions from their superiors first.

54.5. Express my concern that should the defence not be called in the said murder trial, the accused, Azilah and Sirul will not have to swear on oath and testify as to the instructions they received and from whom they were given.

55. And I make this solemn declaration conscientiously believing the same be true and by virtue of the provisions of the Statutory Declaration Act 1960.

Liputan Kes Liwat Anwar ( 4Julai 2008)

The Star : Friday July 4, 2008

Anwar’s accuser visited DPM at his home before lodging police report

KUALA LUMPUR: Mohd Saiful Bukhari Azlan met with Deputy Prime Minister Datuk Seri Najib Tun Razak at the latter’s home to seek his view a few days before he lodged a police report against Datuk Seri Anwar Ibrahim.

In disclosing this yesterday, Najib who described Saiful as traumatised, said he listened and was sceptical about the accusation at first.

“I told him I leave it to him,” said Najib, who also said it was the first time he had met Saiful.

He added that when Saiful came to ask for a scholarship earlier, the latter met Najib’s special officer at his office. Stressing that there was no conspiracy against Anwar, Najib said he was sceptical of Saiful’s accusations and did not want to make any conclusions when Saiful told him he had been sodomised by the PKR adviser.

Najib said he then told Saiful that it was up to him if he wanted to lodge a police report against Anwar. Asked why he thought that Anwar was making personal attacks against him, Najib said he did not know, adding that perhaps Anwar thought that he was conspiring against him.

“There’s no conspiracy. Actually, this boy came to me to complain that he was sodomised by Anwar. “I was not convinced at first whether his story was true or otherwise. “I said to him ‘It’s up to you.’ I left it to him to decide whether he wanted to leave it to the police to investigate and carry out the next course of action.

“I saw him as genuine because he looked so frightened. His hands were cold. “I advised him to make his own decision, and he decided to tell me everything on what had happened. “I was not sure whether he was going to lodge a police report,” he added.

Asked what Saiful had told him, Najib said: “A lot. “The stories are many. Maybe I will reveal them later, but only after the case is completed.”

Najib said the main issue was whether sodomy had happened or not. Asked whether he would give a statement if an investigation were launched, Najib said he only heard Saiful’s allegation.

“The statement should be from him. It’s important that it should be from him, not from me,” he added. “You cannot link the two things (Saiful’s visit to the DPM’s office and his meeting with Najib) together. “He just came for help and he never met me when he came to the office (seeking a scholarship),” he added.

Najib mengaku jumpa Saiful

Muda Mohd Noor Malaysiakini : Jul 3, 08 7:38pm

Timbalan perdana menteri Datuk Seri Najib Razak mengaku bahawa Mohd Saiful Bukhari Azlan datang menemuinya beberapa hari sebelum membuat laporan polis mendakwa diliwat oleh Datuk Seri Anwar Ibrahim.

Saya menerima kedatangannya atas sifat saya seorang pemimpin. "Dia datang beberapa hari lalu, sebelum laporan polis dibuat.

Sementara angkatan muda PKR semalam mencabar Najib menafikan pernah bertemu Mohd Saiful.

Ezam: Sodomy claims an Anwar tactic

SHAH ALAM: The sodomy allegations made against PKR adviser Datuk Seri Anwar Ibrahim is a tactical move by him to politicise the matter and make it into an international issue.

“It is also unfair of him to accuse Umno leaders of political conspiracy. Anwar, who is asking others to be fair to him, must first be fair to others,” said former PKR stalwart Ezam Mohd Nor.

Ezam criticised Pakatan Rakyat’s politics, saying that it went against the foundations laid by the nation’s founding fathers.

“The foundations for multi-racialism was initiated by our founding fathers whereby Malaysians can vote for candidates of any race during the general election,” he said.

He added that Umno and Barisan Nasional leaders must counter the impending threat from Pakatan Rakyat.
